Acceptance of Terms

By accessing, browsing, or using the website and services of Jai Malhar Human Capital Pvt. Ltd. ("Company," "we," "us," or "our"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy, incorporated herein by reference.

If you do not agree to these Terms, you must immediately discontinue use of our platform. These Terms apply to all visitors, registered users, candidates, employers, and any other persons who access or use our services.

Important: These Terms constitute a legally binding agreement. Your continued use of the platform after any modifications constitutes your acceptance of the revised Terms.

Use of Platform

Our platform connects job seekers with employers and provides HR consultancy services. You agree to use the platform only for lawful purposes consistent with these Terms. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the platform subject to:

  • You must be at least 18 years of age to register and use our services.
  • You must provide accurate, current, and complete information during registration and keep it updated.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must not share your account credentials with any third party.
  • You must notify us immediately of any unauthorized use at jaimalharhumancapital@gmail.com.

We reserve the right to suspend or terminate your account at any time if you have violated these Terms or engaged in conduct harmful to other users or the Company.

Candidate Registration & Fees

Individuals seeking employment ("Candidates") may register to access job listings, apply for positions, and receive career support. By registering as a candidate, you agree:

  • A one-time, non-refundable registration fee of ₹1,000 is required to create and activate your candidate profile.
  • The fee covers profile creation, resume review, access to job listings, job matching, and dashboard access.
  • You must upload accurate and truthful information including resume, work experience, and qualifications.
  • Submission of false or fraudulent information will result in immediate account termination without refund.
  • Your profile will be reviewed within 2–5 business days of payment confirmation.
Fee Notice: The ₹1,000 registration fee is a one-time payment with no recurring charges. Optional consultation sessions are available at ₹499 per session.

We do not guarantee placement or employment. Job placement depends on your profile, qualifications, and availability of suitable openings.

Employer Registration & Responsibilities

Companies ("Employers") may register to post job openings, access candidate profiles, and utilize our recruitment services. Employer registration is free for standard access. By registering as an employer, you agree to:

  • Provide accurate and complete company information including legal name, registered address, and contact details.
  • Post only genuine, lawful job openings complying with applicable Indian labor laws and regulations.
  • Not discriminate against candidates on the basis of caste, religion, gender, age, disability, or any other protected characteristic.
  • Maintain confidentiality of candidate information and use it solely for recruitment purposes.
  • Not share, sell, or transfer candidate data to any third party without explicit consent.
  • Promptly update or remove job listings that are no longer active.

Premium services including dedicated sourcing, background verification, and bulk hiring support are subject to separate agreements. Please contact us for details.

Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

  • Posting false, misleading, defamatory, or fraudulent content, job listings, or profile information.
  • Impersonating any person, company, or entity, or misrepresenting your affiliation.
  • Using the platform to solicit money or personal information from other users under false pretenses.
  • Attempting to gain unauthorized access to any portion of the platform or other user accounts.
  • Using automated tools, bots, scrapers, or crawlers to extract data without our written consent.
  • Uploading or transmitting viruses, malware, or any other malicious code.
  • Engaging in any activity that violates applicable Indian laws, including the Information Technology Act, 2000.
  • Harassing, threatening, or abusing other users of the platform.

Violation of any of the above may result in immediate account suspension or termination, and we reserve the right to report such conduct to appropriate law enforcement authorities.

Intellectual Property

All content on this platform—including text, graphics, logos, icons, images, data compilations, and software—is the property of Jai Malhar Human Capital Pvt. Ltd. or its content suppliers and is protected by applicable Indian and international intellectual property laws.

You are granted a limited license to access and view platform content for personal, non-commercial use only. This license does not include the right to:

  • Modify or copy the materials for commercial use or public display.
  • Remove any copyright or other proprietary notations from the materials.
  • Transfer the materials to another person or mirror them on any other server.
  • Use any data mining, robots, or similar data gathering and extraction tools.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by us at any time without notice.

Disclaimer of Warranties

The materials and services on our platform are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we expressly disclaim all warranties, including:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Warranties that the platform will be uninterrupted, error-free, or free of viruses or harmful components.
  • Warranties regarding the accuracy, reliability, or completeness of any content on the platform.
  • Warranties that job listings posted by employers are genuine, accurate, or currently available.
  • Warranties that use of the platform will result in employment or successful recruitment outcomes.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Jai Malhar Human Capital Pvt. Ltd., its directors, employees, partners, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including:

  • Loss of profits, revenue, data, goodwill, or other intangible losses.
  • Damages resulting from your access to or inability to access or use the platform.
  • Damages resulting from any conduct or content of any third party on the platform.
  • Damages arising from failure to secure employment or fill a position through our platform.
Cap on Liability: Our total liability to you for any claims shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or ₹1,000, whichever is greater.

Refund Policy

Please review our refund policy carefully before making any payment:

  • Candidate Registration Fee (₹1,000): Generally non-refundable once your profile has been created and reviewed by our team.
  • Consultation Fee (₹499): Non-refundable once the session has been conducted. Rescheduling requires at least 24 hours' notice.
  • Exceptional Circumstances: If you believe you are entitled to a refund due to a service failure on our part, contact us within 7 days of the transaction at jaimalharhumancapital@gmail.com.
  • Duplicate Payments: In the event of a duplicate or erroneous payment, we will process a full refund within 7–10 business days upon verification.

All refund requests are reviewed on a case-by-case basis. Approved refunds will be processed to the original payment method within 7–10 business days.

Governing Law & Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Specifically, the following laws apply:

  • The Indian Contract Act, 1872
  • The Information Technology Act, 2000 and its amendments
  • The Consumer Protection Act, 2019
  • Any other applicable Indian laws and regulations

Any disputes arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts located in Nagpur, Maharashtra, India. You consent to the personal jurisdiction of such courts and waive any objection to the laying of venue of any such proceeding.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of significant changes by:

  • Updating the "Last Updated" date at the top of this page.
  • Sending an email notification to registered users where appropriate.
  • Displaying a prominent notice on our platform.

Your continued use of the platform after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using our services and may request account deletion by contacting us.
