1. Acceptance of Terms

By accessing or using the Jai Malhar Human Capital Pvt. Ltd. platform ("Platform"), website, or any of our services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Platform.

These Terms constitute a legally binding agreement between you ("User") and Jai Malhar Human Capital Pvt. Ltd. ("Company", "we", "us", or "our"), a company registered in Nagpur, Maharashtra, India.

2. Services Offered

Jai Malhar Human Capital Pvt. Ltd. provides the following HR and recruitment services:

• Permanent Staffing: Connecting qualified candidates with permanent employment opportunities
• Contract Staffing: Providing temporary and contract workforce solutions
• Training & Development: Soft skills, communication, and professional development programs
• Job Portal: Online platform for candidates to upload resumes and apply for jobs
• Employer Services: Recruitment support, candidate screening, and HR consulting
• Career Counselling: Guidance for job seekers on career planning and development

3. Registration & Eligibility

To use certain features of our Platform, you must register an account. By registering, you confirm that:

• You are at least 18 years of age
• You are legally eligible to work in India (for candidates)
• All information provided during registration is accurate, current, and complete
• You will maintain the accuracy of your information and update it as necessary
• You will keep your login credentials confidential and not share them with others
• You are responsible for all activities that occur under your account

4. Registration Fee

Candidates are required to pay a one-time registration fee of ₹1,000 (One Thousand Rupees) to access the full features of our job portal, including:

• Resume upload and profile creation
• Access to all active job listings
• Ability to apply for unlimited jobs for 1 year
• Application tracking and status updates
• Priority consideration by our recruitment team
• Career counselling support

The registration fee is processed securely through Razorpay payment gateway. Employers are not required to pay a registration fee but are subject to admin approval before posting jobs.

5. Candidate Obligations

As a registered candidate, you agree to:

• Provide accurate and up-to-date information in your profile and resume
• Upload only your own resume and not impersonate others
• Apply only for positions you are genuinely interested in and qualified for
• Respond promptly to interview calls and employer communications
• Inform us if you have accepted a job offer so we can update your status
• Not use the platform for any fraudulent or misleading purposes
• Not share your account credentials with others

6. Employer Obligations

As a registered employer, you agree to:

• Provide accurate company information and legitimate job postings
• Post only genuine job openings with accurate descriptions and requirements
• Not discriminate against candidates based on caste, religion, gender, age, or disability
• Maintain confidentiality of candidate information obtained through our platform
• Not use candidate data for purposes other than recruitment
• Comply with all applicable Indian labour laws and regulations
• Notify us when a position has been filled so we can update the listing

Employer accounts are subject to admin approval. We reserve the right to reject or revoke employer accounts that violate these terms.

7. Payment & Refund Policy

Payment: The ₹1,000 registration fee is collected via Razorpay and is non-transferable. Payment must be completed to activate your candidate account.

Refund Policy:

• Refunds are not provided once the registration fee has been paid and the account has been activated
• In case of a technical failure during payment where the amount is deducted but the account is not activated, please contact us within 7 days for resolution
• Refund requests due to technical issues will be processed within 7–10 business days

8. Privacy & Data

We are committed to protecting your personal information. By using our Platform, you consent to the collection and use of your data as described in our Privacy Policy.

Key points regarding your data:

• Your resume and personal information are shared only with employers for recruitment purposes
• We do not sell your personal data to third parties
• You may request deletion of your account and data at any time
• We use industry-standard security measures to protect your data

9. Prohibited Activities

You agree not to engage in any of the following activities:

• Posting false, misleading, or fraudulent job listings or profiles
• Collecting or harvesting personal information of other users
• Using the platform to send spam or unsolicited communications
• Attempting to gain unauthorized access to any part of the platform
• Uploading malicious code, viruses, or harmful content
• Impersonating any person or entity
• Using the platform for any illegal purpose
• Reverse engineering or attempting to extract source code

10. Limitation of Liability

Jai Malhar Human Capital Pvt. Ltd. acts as an intermediary connecting job seekers and employers. We do not guarantee:

• That any candidate will secure employment through our platform
• The accuracy of job listings posted by employers
• The suitability of any candidate for any particular position
• Uninterrupted or error-free operation of the platform

To the maximum extent permitted by law, our total liability to you for any claims arising from your use of the platform shall not exceed the amount paid by you as registration fee.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms. Upon termination:

• Your access to the platform will be immediately revoked
• No refund of the registration fee will be provided for violations of these Terms
• We may retain your data as required by law

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Nagpur, Maharashtra, India.

We encourage resolution of disputes through mutual discussion before resorting to legal proceedings.
